The Supreme Court bench of Justice J.K. Maheshwari and Justice Vijay Bishnoi on Tuesday asked the Rajasthan Government to clarify whether it is still pressing its 2021 application to withdraw prosecution sanctions against then Bhopalgarh MLA Pukhraj Garg and then Merta MLA Indira Bavri, in connection with the violent clash at Banjaron ki Dhanies, Nagaur, that claimed a life in August 2019.

The case arises from the events of 25 August 2019, when during an anti-encroachment drive directed by the Rajasthan High Court, a mob allegedly instigated by local leaders attacked the administration and police team, fatally injuring JCB driver Farooq Khan who later died. An FIR was registered against several accused, including the two MLAs, under serious charges of rioting, conspiracy, and murder.

On 17 February 2021, a State-level committee recommended withdrawal of prosecution against the MLAs, followed by a government order on 20 February 2021 directing the Prosecution Officer to file an application under Section 321 CrPC, which was moved before the Magistrate on 26 February 2021. However, on 3 June 2021, the Rajasthan High Court, while hearing a bail plea of one Accused Deva Ram, quashed the withdrawal order. The State then approached Supreme Court, which on 11 April 2022 stayed the High Court’s interim order.

During today’s hearing, the Bench specifically asked Additional Advocate General Shiv Mangal Sharma, appearing for the State of Rajasthan, whether the Government still intends to pursue withdrawal of the prosecution, and granted two weeks’ time to return with clear instructions .

The government of Rajasthan has now to Review the order, withdrawing prosecution and come back to the Supreme Court with the side decision.

The matter will be listed after two weeks and Supreme Court to consider whether the government in 2021 rightly withdrawn the prosecution against the two then MLA.
