The Commercial Courts Act, 2015 is an Indian legislation enacted to provide for the speedy resolution of commercial disputes. The Act establishes commercial courts, commercial divisions of high courts, and commercial appellate divisions to hear and dispose of commercial disputes. The Act defines commercial disputes as those arising from transactions related to trade, commerce, and investments, including those arising from agreements relating to movable or immovable property, intellectual property rights, joint ventures, partnership agreements, insurance, and banking. The Act provides for the appointment of judges with expertise in commercial matters to preside over the commercial courts and divisions. It also mandates the time-bound disposal of cases and encourages alternative dispute resolution mechanisms such as arbitration and mediation. The Act also establishes a Commercial Appellate Division in each high court to hear appeals from the commercial courts and commercial divisions. The appeals must be disposed of within six months. The Commercial Courts Act, 2015 is aimed at providing a more efficient and effective mechanism for the resolution of commercial disputes, which is crucial for promoting business and investment in India.
