Abstract:
This talk provides a comprehensive historical review of Japanese scholarship on Chinese law, tracing its evolution from the 6th century to the present. The first stage, from the 6th century to 1885, involved the study of Chinese law for legislative purposes and the interpretation of the Lü-Ling system (律令制). During the second stage (1885–1911), Japanese scholars focused on traditional Chinese law to provide rational explanations for Japanese tradition and for colonial governance. The third stage (1911-1949) saw scholars like Professor NAKADA Kaoru of Tokyo Imperial University begin analyzing traditional Chinese law through modern jurisprudence. Japanese legal professionals also respected and engaged with the laws of the Republic of China. The fourth stage (post 1949) continues with scholarly interest in the legal system of the People’s Republic of China.
Speaker:
TAKAMIZAWA Osamu is Emeritus Professor of the University of Tokyo and Adjunct Chair Professor of Shandong University Law School. He received his LL.B., LL.M., and LL.D. from the University of Tokyo in 1982, 1984, and 1994, respectively. His field of research covers disputes and dispute resolution in China, as well as sources of law in China and modern Chinese legal history. His major publications include Disputes and Law in Contemporary China (『現代中国の紛争と法』、 東京大学出版会、1998; Chinese edition, 2003), Introduction to Contemporary Chinese Law (Co-Author,『現代中国法入門』、有斐閣、初版~第9版、1998~2022), What is Law for China (Co-Author, 『中国にとって法とは何か』、岩波書店、2010), Key Issues in Chinese Law (Co-editor & author, 『要説 中国法』、東京大学出版会 、2017).
