You wake up in the morning, check your bank account, and your balance is dramatically lower than usual. What does this mean? Our attorney David Stevens explains what happens when your bank account is levied and what you can do.
Are creditors allowed to swipe your money directly from your account? The answer is yes, but it doesn't mean you are powerless.
A bank levy is a legal action that allows creditors to take funds from your bank account. Your bank freezes funds in your account, and the bank is required to send that money to creditors satisfy your debt.
In order for your creditor to request funds immediately from your bank account indicates the creditor has received approval from your bank proving a legal judgement against you.
Once your creditor has completed this request, your bank will automatically freeze your account and analyze this situation. However, your bank may or may not notify you that your balance has lowered and your creditor has taken your money. What's more, your creditor may not inform you either.
So what do you do? To potentially limit and prevent levies on your account, consult an experienced attorney to determine what your options are. There are several approaches you can utilize during this time.
