SUPREME COURT HEARING: Waqf Board Portal Dispute (Waqf by Survey vs. Waqf by User)
In a significant legal development, the Supreme Court has refused to entertain a plea challenging the new mandatory online portal for Waqf registration introduced by the Ministry of Minority Affairs.
The Bench led by Justice Surya Kant and Justice joymallo bagchi made it clear that technical or administrative grievances regarding a web portal should first be addressed by the relevant government authorities, not the Supreme Court.
🔥 THE CORE ISSUE: The Petitioner argued that the new portal forces them to register as "Waqf by User", effectively erasing their historical status as "Waqf by Survey". They expressed fear that this change could lead to:
Loss of Property Rights: Vulnerability to encroachers.
Penalties: Severe action under Section 61 of the Waqf Act for non-compliance.
Identity Crisis: Dilution of the Waqf's legal character.
⚖️ WHAT THE SUPREME COURT SAID:
"Why come to SC?" The Court questioned why the petitioner approached the highest court for a portal glitch/classification issue.
"Go to Govt First": The Bench granted liberty to the petitioner to approach the "prescribed authorities" (Ministry/Central Waqf Council) for clarification.
"Data vs Identity": Justice Datta clarified that merely uploading data to a portal does not change the legal nature of the Waqf, which is based on its Deed.
