The crime of "reckless driving" is driving with a wanton disregard for the safety of others, it is much more than just speeding or running a red light. In order to be found guilty of reckless driving, the police must prove that you operated your vehicle in a way that was extremely dangerous, such as speeding in a residential neighborhood while texting and running a red light. When someone suffers a minor injury because of your reckless driving, you can be charged with Vehicle Code 23104 VC, "reckless driving causing injury". But if someone suffers a serious injury because of your reckless driving, the crime can lead to even more punishments, and charges of Vehicle Code 23105 VC, "reckless driving causing serious injury".
California law defines a "serious injury" as: a broken bone, a laceration which requires extensive suturing, causing a concussion or loss of consciousness, or extensive organ damage.
If you are found guilty of Vehicle Code 23105 VC, it is a wobbler under California law, and can be charged as either a misdemeanor or felony depending on the seriousness of the injuries and the discretion of the prosecution. If charged as a misdemeanor, it can lead to up to 1 year in jail. As a felony, you can face up to 3 years in jail or prison.
However just because an injury accident occurs and you are charged with Vehicle Code 23105 VC, it doesn't mean you are guilty. The police must prove without a doubt that you were driving recklessly, and not just a lapse of attention or regular negligence. Sometimes the accident turns out to be the other driver's fault, and you were not responsible for the crash at all.
