The Lilongwe Magistrate Court has today set aside a police search warrant targeting the residence of former president Lazarus Chakwera in connection with the alleged illegal possession of dogs.
The order was granted after lawyer George Jivason Kadzipatike, representing Chakwera, successfully challenged the warrant, arguing that the State misled the court to obtain it.
The warrant was related to four dogs—one Dutch Shepherd and three Malinois.
In an interview with Nation Online this evening, Kadzipatike said: "I can confirm that the Court has granted a stay order on the search warrant pending the determination of our application to completely vacate the warrant. What it means is that the warrant is no longer in force."
The case was heard by Magistrate Robert Botha, the same judicial officer who initially issued the warrant.
According to Kadzipatike, since the warrant was obtained ex-parte, the legal procedure was to return to the same court to challenge it.
“We demonstrated before the Court how the State had misled it and irregularly obtained the warrant,” he said.
Kadzipatike also disclosed that he presented a fresh bail application for the primary suspect in the case, Godfrey Jalalé. The court is expected to deliver its ruling on bail tomorrow.
