The U.S. Senate recently introduced the Halting International Relocation of Employment (HIRE) Act, legislation that could reshape how CPA firms use offshore providers.
At its core, the bill would:
• Impose a 25% excise tax on payments to foreign providers when services benefit U.S. consumers.
• Eliminate the tax deductibility of outsourcing expenses.
• Grant Treasury broad anti-avoidance powers, while exempting U.S. territories like Puerto Rico.
For firms relying on offshore talent, the financial impact could be dramatic. A $100,000 outsourcing payment that today nets down to $79,000 after tax could rise to as much as $146,000 under the HIRE Act.
This would make direct offshore arrangements far less viable, increase the appeal of U.S. intermediaries or territorial structures, and potentially give larger firms with domestic service centers a competitive advantage.
But it’s not all negative—new reporting and compliance requirements could also create advisory opportunities for proactive CPA firms.
The bill is still early in the legislative process, and its likelihood of passage remains uncertain. Still, it signals increasing scrutiny of outsourcing that firms should not ignore.
