In the Rajya Sabha elections held on March 16, 2026, the Biju Janata Dal (BJD) and the Indian National Congress faced significant setbacks due to cross-voting by at least 10 of their MLAs. These legislators defied party whips to support BJP-backed independent candidate Dilip Ray.
Rajya Sabha elections use an open ballot where MLAs must show their marked ballot to their party’s authorized agent before casting it. Unlike general elections, cross-voting in Rajya Sabha polls does not attract disqualification under the Anti-Defection Law (Tenth Schedule), as ruled by the Supreme Court in the Kuldip Nayar v. Union of India (2006) case. However, the party can still take internal disciplinary action against the defying members.
