The Mental Health (Compulsory Assessment and Treatment) Act 1992 is Aotearoa New Zealand’s mental health law.
Every 46 minutes, a New Zealander believed to need acute mental health support goes under this law. This could be you, or someone you love.
Find out how the Mental Health Act works and how someone goes under it, by watching our short video above.

Help change the Mental Health Act
It’s widely agreed the Mental Health Act needs urgent change. On 1 October 2024, the Government released a new draft of this law (called the 'Mental Health Bill') to replace it.
No matter who you are – a person who has been under the Mental Health Act, a friend or family member, or part of the media – you can influence this law to change for the better by having your say on this new draft law by midnight, Friday 6 December 2024.
Visit our dedicated hub on the Mental Health Foundation’s website, rethinktheact.nz, to find out why the Mental Health Act needs urgent change and how you can play your part.
