When is an Oregon DUI a felony? A DUI is a felony in Oregon when you have 3 prior DUI convictions in the last 10 years. Practically speaking since Oregon has diversion for the first DUI that means you could have had 4 prior DUIs in the last 10 years before your DUI is a felony if you had attended diversion. That would have been 3 convictions, one DUI diversion, and then your subsequent DUI would be a felony.
