The Mandatory Settlement Conference (MSC) is the last-ditch effort, or the last stop, in your litigation before trial. It’s the courts way of saying, “Alright you two, you have one more chance, through a four-way settlement conference with a skilled family law attorney, to resolve any outstanding issues you have so that you do not go to trial.”
Trial is outrageously expensive and very time consuming, because it can be months, sometimes even up to a year, before you can get a trial date. That type of money and time is never good for anyone’s mental health or pocketbook.
So, the court literally pulls everyone in and says, “This is your last-ditch effort, make good use of the skills of this experienced attorney, and try to get things settled.”
Jane Wesley Brooks, of JWB Family Law, works as a Mandatory Settlement Conference judge for the courts in San Diego. JWB Family Law has a very good success rate of getting cases settled. We have found that most people just need to hear exactly what their attorney has told them, but from someone else who is also an attorney in family law.
Mandatory Settlement Conferences are very, very useful, but you need to remember that both parties need to leave a nickel on the table and meet in the middle for it to work. No one in a Mandatory Settlement Conference is going to get everything that they want because in the end it is a settlement. It’s deciding to meet somewhere in the middle to stop the craziness of litigation and the expense.
If you have a Mandatory Settlement Conference, put a lot of time and effort into getting things done that day. If you need the assistance of JWB Family Law, we are happy to help. To set up a consultation, call (619) 234-6123 or visit our website at https://jwbfamilylaw.com/.
