Becerra acknowledged the trust and treaty responsibility of the United States to provide health care to tribes and their citizens. But he declined to go into specifics about the nature of these duties when asked by Vice President Alicia Mousseau of the Oglala Sioux Tribe, whose leaders signed the Treaty of Fort Laramie in 1868.

Becerra, a former member of Congress and a former attorney general of California, cited ongoing litigation as the reason for his reticence. The Biden administration is currently considering whether to keep fighting a decision in which the 8th Circuit Court of Appeals ruled that the U.S. has a duty to provide “competent physician-led healthcare” to the Rosebud Sioux Tribe, a fellow signatory to the 1868 treaty.

The Department of Health and Human Services includes the Indian Health Service, the federal agency that is charged by law with providing health care to more than 2.6 million American Indians and Alaska Natives.
