How do I apply for a Labour Market Impact Assessment for high-wage and low-wage positions?
Canadian employers can hire temporary foreign workers for wages below or above the provincial/territorial median hourly wage. To apply for Labour Market Impact Assessment for high-wage and low-wage positions you need to complete the following process:
● Cover the processing costs in the amount of $1,000 for each Labour Market Impact Assessment (LMIA) application.
● Provide a:
○ Cap in the proportion of temporary foreign workers you can hire in low-wage positions at a specific location or
○ Transition plan for high-wage positions by completing three different recruitment, retention or training activities for Canadian workers on the job position.
● Meet the distinct language assessment factor criterion that allows only stating English and French as job requirements, unless you demonstrate that another language is crucial for the job position.
● Ensure that the temporary foreign workers have all relevant training, qualifications and experience.
● Ensure that temporary workers meet the criteria for regulatory occupations, such as certification, registration or licensing.
● Pay the transportation costs for the temporary foreign workers.
● Organize adequate affordable accommodation.
● Get health insurance and guarantee workplace safety.
● Draft an employment contract and cover the recruitment costs, if any.
● Obtain a business license, if applicable.
