Can the Government read a private message, block a webpage, analyse network traffic, or demand cyber-incident logs? These actions are often described as one idea—“surveillance”—but Indian law separates them into distinct powers with different objects, grounds, authorities and safeguards.
Episode 7 of Beyond Bare Act explains Sections 69, 69A, 69B and 70B of the Information Technology Act, 2000 in plain language. Using Riya’s continuing case, we examine interception, monitoring and decryption; public-access blocking; cyber-security traffic data; CERT-In incident response; emergency procedures; duration and review; encryption; and the constitutional tests under Articles 14, 19 and 21.
The episode also explains the correct holdings of PUCL, Justice K. S. Puttaswamy, Shreya Singhal, the Pegasus proceedings and Anuradha Bhasin. It distinguishes Section 69A blocking from the Section 79/Rule 3 actual-knowledge route and from a telecom-service suspension under the Telecommunications Act, 2023 and the 2024 Rules.
