The 18th Constitutional Amendment is a landmark in the constitutional history of Pakistan. It made provinces more independent and made Pakistan a parliamentary democracy.
After the election of 2008, the PPP government led by Yousuf Raza Gilani made a Parliamentary committee on the constitutional reforms. This committee proposed some amendments to the constitution of Pakistan. The result was the passage of the 18th constitutional amendment on 19 April 2010. There were 100 amendments which affected almost 83 articles of Pakistan’s constitution.
The 18th Amendment changed the name of NWFP to Khyber Pakhtunkhwa (KPK). The name of Baluchistan was changed to Balochistan. Similarly, the name of Sind was changed to Sindh. Article 6 (2A) was added to the constitution according to which an act of high treason shall not be validated by any court of law. Article 58 (2B) was removed from the constitution.
A new article 175A was inserted into the constitution. According to this, a judicial commission will be formed which will name the vacant seat of judge to the parliamentary committee. A parliamentary committee then will confirm the nomination of judges by a simple majority. In the same way, the election of Chief Election Commissioner was made more democratic. Now, the parliamentary committee will also select the Chief Election Commissioner.
One of the main features of the 18th constitutional amendment was that it decentralized the power structure in the country. The concurrent list in the constitution was abolished and all the powers in the concurrent list were given to the provinces. In short, the 18th constitutional amendment was the amendment which made Provinces more strong and Pakistan a democratic country in its true spirit.
