What Is Misdemeanor Diversion In California?

In January 2021, the California State Legislature enacted California Penal Code 1001.95 which permits a Judge in a misdemeanor criminal case to grant diversion to people accused of most
misdemeanor offenses.

Diversion means that a criminal case will be “diverted” from a conviction and towards the dismissal of the case if certain things are completed like community service, classes, and the like. Before 1001.95 diversion, there had always been a kind of “informal diversion” between the prosecutor and defendant which had various benefits and would either be pre-filing or post-filing diversion and if post-filing diversion, either pre-plea or post-plea diversion.
