Three ways for a child to come into the UK. First, where a parent is (i) an EEA national, or (ii) refugee or has humanitarian protection known as HP; or (iii) is a British or settled in the UK.
EEA parent, the child is under 21 years age, the application is an EEA family permit application online, it’s free and the documentary evidence (i) is the relationship status. So the birth certificate of the child to show that EEA national is a parent, (ii) child’s passport (iii) EEA national is and documents to show that the parent is in communication with a child, communication (iv) records (v), records that parent is working in the UK such as payslips, (vi) the parent has living in the UK so council tax bill, tenancy agreements and things like that.
Party refugee status / HP. This is where the child is under 18 and was born before parent was granted refugee status. The application is family reunion. It is again free and it’s made online and document evidence would be again the (i) parents passport or ID for refugee status or HP status endorsed by Home Office and the child’s birth certificate and the child’s passport or any ID the (ii)child might have. Also the TV certificate to make sure the child is healthy.
Parent; British or Settled, there are few requirements in this application and the key things are to note as follows (i) the parent is either British or settled living in the UK. The parent usually would have sole responsibility (i.e. other parent is deceased or there where abouts is unknown or takes no role in the childs upbringing) the child’s upbringing and the child is overseas, is under 18 years age. Parent has to show sole responsibility of the child in terms of making all decisions regarding the child’s upbringing, welfare, education, health, disciplining etc. The parent would have to show this by way of documentary evidence (e.g. money tranfer reciepts and communication record) including who the child is being looked after when the parent is in the UK and why the carer cannot continue.
In this application, there is no financial requirement so the parent is not required to show that a particular amount of earnings need to be made. No, it’s just parent would have to show they are not relying on public funds and will not rely on public funds if the child were to come in the UK so the parent possibly would have to show employment or self-employment documentary evidence to support their income
The last way where say the sole responsibility aspect is not met or is not strong enough to meet by way of documentary evidence, however, if the child were to continue remaining overseas without the parent going there, and the child would suffer harm or any exceptional circumstances which would make the child exclusion from the UK undesirable, again the threshold for this aspect is very high, therefore submit the app with documentary evidence that if the child is not going to come in the UK the child would suffer.
