Justices Sanjiv Khanna and Sanjay Kumar reaffirmed that secularism is fundamental to the Indian Constitution, particularly concerning the principles of equality, fraternity, and the rights enshrined in Part III. Justice Khanna clarified that India's approach to secularism differs from the French model, focusing on inclusivity rather than a strict separation of religion and state. The petitions, filed by individuals including Balram Singh and Dr. Subramanian Swamy, argue that these amendments alter the original intent of the Constitution’s framers. While the petitioners did not dispute India’s secular character, they contested the 1976 insertion of "socialist" and "secular." Advocate Vishnu Shankar Jain expressed concerns over Dr. Ambedkar's reservations about "socialism," implying it could limit personal liberty. However, Justice Khanna noted that in this context, socialism refers to equality of opportunity and equitable wealth distribution. The court has scheduled the case for further hearing in November.
