In recent years, many of the leading forums for international dispute arbitration have implemented major rules changes. The International Centre for Dispute Resolution issued new rules in 2014, and the International Chamber of Commerce issued new expert rules in 2015. The rules changes at these and other prominent forums make clear that discovery should be limited. There are also rules for consolidating arbitration and emergency protection or injunctive relief. The changes have had a major impact on the options available to companies and counsel in managing the process of international dispute resolution. In this program, we will analyze the recent rules changes and discuss how they can be used in drafting more effective dispute resolution clauses and in preparing cases for hearing in international arbitral forums.
