The Diplomatic and Consular Staff Case (U.S. v. Iran) | 1980 I.C.J. 3 (1980)

The Diplomatic and Consular Staff Case was the case brought by the United States before the International Court of Justice during the Iran hostage crisis.

On November fourth, nineteen seventy nine, a group of armed militants called the Muslim Student Followers of the Imam’s Policy seized the United States embassy in Tehran and took hostages. The Iranian military didn’t try to stop the attack.

Under the leadership of Ayatollah Khomeini, Iran announced that it had taken the hostages in response to U S actions supporting the Shah of Iran. Iran said it would release the hostages after the U S returned the Shah for trial.

Iran refused to negotiate with the U S and the United Nations.

The U S sued Iran in the International Court of Justice. It alleged that by failing to protect the embassy and its staff, Iran had violated the Vienna Conventions on Diplomatic and Consular Relations and the Treaty of Amity, Economic Relations, and Consular Rights between the United States and Iran.

Iran refused to attend the proceedings. Instead, Iran sent the court two letters stating its position. Iran blamed the C I A for instigating the nineteen fifty three coup d’etat that overthrew its lawful government and restored the Shah. Iran refused to acknowledge the court’s jurisdiction.
