The Okhuesan Traditional Council says its attention has been drawn to a recent Television interview granted to one Senior Advocate of Nigeria, SAN, Chief Dan Okoh concerning the Traditional Stool in the Community.
A statement by Secretary Okhuesan Traditional Council, Mr. Victor A. Ataime says the subject is a matter pending at the High Court of Justice, Benin City.
The Statement notes that during the pendency of the suit involving the Chieftaincy dispute, in which the letter of appointment as Onogie of Okhuesan meant for the 4h Claimant Lucky Ehi-Douglas Ehidiamen, was diverted to the First Defendant, Emmanuel Ehikioya Imadojemu, the parties sought to resolve the dispute out of court.
The Statement said in this regard, parties were duly invited to appear before a panel set up by the Edo State Ministry of Local Government and Chieftaincy Affairs for this purpose, which had in attendance some Traditional Rulers in Esan Land.
It said all parties to the suit participated fully in the said proceedings with their respective Counsel and the first Defendant knew that the panel will come out with a decision at the end of the proceedings.
The Statement said none of the parties objected to the out-of-court settlement proceedings on the ground that the matter is pending in Court adding that at the end of the proceedings, recommendations were made to the Edo State Government concerning the findings of the panel.
The Statement obsessed that it is not therefore correct that the Edo State government acted without the involvement of the parties, particularly the first Defendant who was represented in all the sittings of the panel by his Counsel.
The Statement adds that it has to be stressed that it is not unusual for parties in a pending Suit to resolve their dispute at any stage of the proceedings even without the approval or sanction of the Court, or prior reference to the Court.
The Okhuesan Traditional Council said Edo State Government has not done anything wrong in the matter when it relied on the findings of the panel to which all parties to the suit voluntarily submitted for resolution of the matter.
