Marcus Zeltzer from Yellow Canary outlines why the introduction of payday super from tomorrow represents a major operational shift for Australian employers. Zeltzer states that directors remain personally liable for late or unpaid superannuation, a regime in place since 1993, but the move from quarterly to payment-within-seven-days of each pay cycle makes that risk far more immediate. He suggests large ASX 100–200 companies are generally better prepared, while small and micro businesses may face serious cash flow pressure and a higher risk of insolvency.
Zeltzer argues that many businesses are not ready despite a long lead time and that payroll and tech vendors face structural changes. Under payday super, organisations must understand new “qualifying earnings” rules, workforce cohorts and what elements of pay attract super. He notes reconciliation challenges, for example where employers choose to pay super on parental leave that is not counted as qualifying earnings in payroll systems.
For employees, Zeltzer flags a potential “15‑month problem” for high income earners. He expects some will see less cash in July as 12% of qualifying earnings flows more consistently into super due to annual caps. He also anticipates more payment bounce backs and warns that the ATO is unlikely to pause enforcement, urging boards not to panic but to show genuine efforts to comply.
