Lawyer Danstan Omari has put the Independent Policing Oversight Authority (IPOA) on notice over the handling of firearms said to have been used in a murder case in Kiamaiko, where police officer Duncan Ndiema is facing a murder charge.
Omari faulted IPOA over the chain of custody of the exhibits, arguing that the authority should not allow the National Police Service (NPS) to retain control of crucial evidence in a case where police officers are under investigation. He maintained that IPOA, as the constitutionally mandated body tasked with probing police misconduct, ought to independently secure and manage such exhibits to safeguard the integrity of the trial.
The issue arose after IPOA informed the court that the firearms, which are key exhibits in the case, could not be produced in court on time. The authority explained that police officers responsible for transporting the guns lacked fuel to facilitate their delivery to court.
Omari criticized the explanation, terming it inadequate and raising concerns about the proper handling and preservation of evidence in the high-profile murder trial.
