In this heated session before the Milimani Magistrates Court, Lawyer Danstan Omari, joined by Lawyer Kinyanjui, cross-examines CAK cyber-security officer Inspector Ezra Koech over his handling of investigations into articles linked to blogger David Bogonko Nyokangi.
The DCI had instructed CAK to investigate a specific email address, but Koech instead analysed the entire domain – kenyaleo.co.ke. Omari questions whether the officer acted outside his mandate, failed to identify the domain owner, and possibly violated the Data Protection Act by investigating a website without clear authority.
Inspector Koech admits he only identified the registrar (Truehost) and did not determine the true owner of the domain or verify the authors of the published posts.
