ENLARGEMENT OF A DWELLINGHOUSE BY CONSTRUCTION OF
ADDITIONAL STOREYS & CONSTRUCTION OF NEW DWELLINGHOUSES
The Town and Country Planning (General Permitted Development) (England)
(Amendment) (No. 2) Order 2020 - laid before Parliament on 21 July 2020
The new regulations will be of particular interest to those seeking to add value to
dwellinghouses and mixed use properties – enlarging buildings with additional storeys or new
flats. The new rights come into effect at 9am on 31st August 2020.
Although badged as ‘Permitted Development’ a ‘Prior Approval’ application must be submitted to the LPA for consideration of a number of key issues, if approval is granted it lasts for 3 years.
The regulations make further amendments to Parts 1 and 20 of Schedule 2 of the 2015 GPDO
(as amended). These include the following:
Schedule 2, Part 1 – which relates to the general enlargement or alteration of a
dwellinghouse - a new class AA is inserted (for buildings built between 1 July 1948 - 28
October 2018) –
Class AA – Enlargement of a dwellinghouse by construction of additional storeys by
(a) up to two additional storeys, where the existing dwellinghouse consists of two or
more storeys; or
(b) one additional storey, where the existing dwellinghouse consists of one storey
Schedule 2, Part 20 (refers to buildings built between 1 July 1948 - March 2018) is also
further amended and includes four new classes as follows:
Class AA - new dwellinghouses on detached buildings in commercial or mixed use
Class AB - new dwellinghouses on terrace buildings in commercial or mixed use
Class AC - new dwellinghouses on terrace buildings in use as dwellinghouses
Class AD - new dwellinghouses on detached buildings in use as dwellinghouses
The key issue in each case is that one or two additional storeys of residential (Class C3)
accommodation is permitted subject to ‘Prior Approval’. In the case of Part 1 Class AA it is to
extend an existing dwelling to enlarge the accommodation and in Part 20 Classes AC & AD to
create additional dwellings in the form of flats.
The new classes are subject to a number of conditions and limitations which include such
matters as previous extensions, maximum height & overall increase in heights, roof pitch,
impact on neighbours, overlooking, privacy & loss of light, impact on a protected view.
