I am Attorney Jonathan Blecher, and I am a criminal defense lawyer practicing in Miami-Dade County. Over my three decades of experience, I have successfully defended more than 3,000 DUI cases. Since this client's defense would involve showing how the wind hindered my client's test performance, I had to prove that the wind gusts were strong in that location at that particular time.
I ended up contacting the National Climatic Data Center in North Carolina, where I was able to prove that at the time and location that my client was tested for DUI, the wind gusts were 20 to 30 mph. After presenting this evidence to the prosecutor's office, my client's case was dismissed.
