Tax Law Controversy: Oyedele Says Tinubu Lacks Power to Suspend Gazetted Laws as SANs Disagree

A fresh legal and policy controversy has erupted over Nigeria’s newly passed tax reform laws, with the Chairman of the Presidential Committee on Fiscal Policy and Tax Reforms, Taiwo Oyedele, insisting that President Bola Tinubu has no constitutional authority to suspend their implementation once they have been passed, signed, and gazetted.
Speaking in an interview, Oyedele dismissed calls for suspension as misguided, arguing that neither the President nor the executive arm of government can halt laws that are already in force. He explained that two of the four tax laws commenced immediately upon gazetting, including provisions that repealed the Federal Inland Revenue Service Act and replaced it with the Nigeria Revenue Service. According to him, any attempt to suspend the laws would create legal and administrative chaos, raising serious questions about revenue already collected and the legal status of the country’s revenue authority.
However, several senior lawyers, including Senior Advocates of Nigeria, have sharply disagreed with Oyedele’s position. They argue that enforcing the laws from January 1, 2026, amid allegations that the gazetted versions differ from what the National Assembly actually passed, would amount to a violation of the rule of law. The lawyers maintain that any discrepancy between the passed and gazetted texts renders the law unconstitutional, null, and unenforceable.
Senior Advocates Mohammed Abeny and J.K. Gadzama described Oyedele’s stance as reckless, warning that such inconsistencies could trigger a major constitutional crisis. They called for immediate suspension of enforcement, legislative corrections, or judicial intervention to restore legal clarity, protect public confidence, and uphold constitutional order as the debate over Nigeria’s tax reforms intensifies.
