Compensation under Motor Vehicle Act
"Section 161 ,163,164 and claims tribunal.
In India, we have a very compressive motor vehicle act. It came up in 1914 then finally it was amended very recently in 2019.
There is a provision of compensation in cases of hit and run motor vehicle accidents. Section 161 of the motor vehicle act provides the compensation of Rs 5 lakh in case of death and rs 50,000 in cases of grievous hurt (loss of hearing, vision, severe pain etc). If a person does not comply with this provision then imprisonment up to 2 years can be given along with /or fine minimum of Rs 25,000.
Section 163 says that if a person took compensation in two provisions then he /she have to refund it.
Section 164 talks about compensation which is fixed 5 lakhs in case of death and 2.5 lakhs in case of grievous injury arising out of motor vehicle accident.
Section 165 talks about the Motor accident Claim Tribunal. It looks into the matter when there is any dispute.
