Premises liability is what holds landowners legally responsible for certain injuries that occur on their property. So even if the landowner was not personally there when the slip-and-fall, dog bite, drowning, or other accident occurred, the accident victim may be able to sue the landowner on premises liability grounds.
However, landowners owe different standards of care to different people depending on what they are doing on their land. For instance, landowners owe a very low duty of care to trespassers because trespassers aren’t allowed to be there to begin with. The only time landowners are liable is if they deliberately hurt the trespassers.
Meanwhile, landowners owe a medium standard of care to licensees, which is the legal term for social guests. Landowners are expected to use reasonable care to protect social guests from dangers the landowner created and knows about, such as, for example, a hole in the ground where the landowner is doing construction.
Finally, landowners owe the highest standard of care to invitees, which are customers. Landowners are required to reasonably protect customers from all dangers the landowner knows of - or should know of - and it doesn’t matter whether the landowner created the danger or not.
Note that the term “landowner” means more than just the person or company that owns the land where the accident occurs. It can also include property managers, tenants, vendors, event organizers, contractors, and any authorized agent of the property.
