368) Can a Bondsman / Surety Arrest me? ~

Описание: Thank you for asking me “Can a Bondsman arrest me?”

The short answer is “Yes”, but note that there’s a difference between a Bondsperson (or a “Surety”) and a Bounty Hunter: Bondspersons, or sureties, are generally on the “law side” - being subject to rules and regulations for ensuring a defendant's bond with the Court - whereas “Bounty Hunters”, or “Fugitive Recovery Agents”, are generally on the “order side” - being subject to laws concerning civil and criminal recovery of Defendants.

Still, in FL there are 3 ways that your surety can apprehend and arrest you:

1) Per F.S. 903.29 if the Court has forfeit your bond then anytime within 2 years from the date of that forfeiture your surety can lawfully arrest you for the purpose of surrendering you to the jail or the Court;

2) Per F.S. 903.20 a surety can physically surrender you to the jail or the Court at any time prior to a breach of bond; and

3) Per F.S. 903.22 your surety can authorize your arrest before the bond has been forfeit and for the purpose of surrendering you to the jail, but absent a bond forfeiture the arrest can’t be made by the surety and can only be done by a police officer if the surety provides written authorization on a certified copy of the bond.

So “Can a Bondsman arrest you?”... Yes.

But they can also either call in Dogg the Bounty Hunter or any law enforcement officer to do it for them. That said...
