Criminal Justice system of Pakistan/India

● Criminal justice system of Pakistan is defined as the set of the agencies and process established by the government to control the crime and impose penalty on those who violate the laws.

● This system has various components which have to work in harmony and support of each other in order to provide justice not only to victims but also to accused persons.

● A good and reliable system of criminal justice not only provides speedy remedy to the victims of a crime but also safeguards and protects the legitimate rights of the accused. The system is based on fairness, equality, justice and fair play.

● Criminal justice is the system of practices and institutions of the government directed at upholding social control and reducing the crime or sanctioning those who violates laws with criminal penalties and rehabilitation efforts.

● Criminal justice system of Pakistan has been inherited from British. This system aims to reduce the crime bringing more offenders to justice and raise public confidence that the system is fair and provide justice to law abiding citizens.

■ Criminal justice system of Pakistan mainly consists of three parts;

i. Police (Law enforcement)
ii. Courts (Adjudication, Trial)
iii. Prisons (Corrections, Probation Parole)

● The major and important deficiencies of this criminal justice system of Pakistan are to accurate the reporting of crime to police, malpractising during litigation, delaying in the submission of challan to the courts by police prosecutors, long duration of trials where the accused is considered to be favourite child of court, Overcrowding in jails due to large number of under a trial prisoners and under developed the system of parole and probation.

(Parole: release from prison early. If someone is given parole they may be returned to prison if they offend again.)

(Probation; An alternative to imprisonment allowing a person found guilty of an offence to stay in the community, usually under conditions and under the supervision of a probation officer. A violation of probation can lead to its revocation and to imprisonment.)

● Criminal justice system of Pakistan includes the Criminal Procedure Act of 1898 that popularly known as CrPC and Pakistan Panel Code 1860, which lay out the foundation, procedure and functions of all.

Components of this system is starting from reporting of the case by police, it's a trial and judication by courts and corrects and appeals at the jail.

● However even though amendments from time to time has been made in laws to cater for changing needs and keep them up to date but major shape is still the same. Unfortunately Pakistan system has failed to achieve the wider objectives.
