In our first edition of Wednesday Winners, Criminal Defense Attorney Seth Peritz takes you through a fact pattern involving a Reckless Driving and Obstruction of Justice case which he litigated in a jurisdiction in Northern Virginia. Attorney Peritz explains how he used the officer’s training and experience against him, and convinced a judge that the stop of his client’s automobile was unconstitutional and, thus, illegal. As a result, the judge ruled that the officer should not have stopped his client for Reckless Driving. Since the Obstruction of Justice was inextricability linked to the officer having stopped his client for the Reckless Driving, the judge dismissed that charge as well.
