⚖️ The Reality Check:
Married Couples: Following the Joseph Shine judgment, Adultery is no longer a crime (No Jail), but it remains a strong ground for Divorce. It can also severely impact your alimony and child custody cases!
Unmarried Couples (The Big Change): Under Section 69 of the Bharatiya Nyaya Sanhita (BNS), having a physical relationship based on a "deceitful promise" or a False Promise of Marriage is a serious crime.
The Penalty: If proven, you could face up to 10 years in prison plus a fine.
The law now demands transparency. Consensual sex is legal, but sex obtained through "deceit" (hiding identity or lying about marriage) is a punishable offense. Stay honest, stay safe!
