A preliminary hearing is an evidentiary hearing that a defendant is entitled to within a certain number of days of being charged with a crime, to ensure that there is sufficient evidence to hold him or her. While minor differences exist between states, its origin comes from a citizen's Constitutional rights. Other names for the hearing include a "probable cause" hearing or a preliminary examination.
