In this video, Abhinav (Abhi) Lohia — former immigration attorney and current Managing Director of Global Business Development at Golden Gate Global, a USCIS-licensed EB-5 Regional Center — explains an aging-out rule that affects EB-5 Investors’ children and shade a light on a critical USCIS policy update impacting EB-5 families and others dealing with the Child Status Protection Act (CSPA) and the child aging out issue.
Starting August 15, 2025, USCIS will use the State Department Visa Bulletin’s final action dates to determine when a visa becomes available for CSPA age calculation. This update creates consistency between how USCIS and the State Department calculate children’s ages, eliminating prior discrepancies between applications processed inside the U.S. and those processed abroad.
Why does this matter?
Because this change could decide whether children “age out” or remain eligible for green cards alongside their parents.
