📝 Short Case Summary:
In the case of Shelly Mahajan v. Ms. Bhanushree Bahl & Anr., the plaintiff (wife) filed a civil suit claiming monetary damages against the defendant (the "other woman") for the tort of Alienation of Affection (AoA). The plaintiff alleged that the defendant knowingly and intentionally interfered in her marriage, leading to an extramarital affair and the eventual breakdown of the marital relationship. The defense argued that under Section 7 of the Family Courts Act, the civil court had no jurisdiction. However, the Delhi High Court ruled that a third-party tort claiming compensation for a civil wrong does not fall under the exclusive jurisdiction of the Family Court. Furthermore, referring to the landmark Joseph Shine judgment on adultery, the Court clarified that decriminalizing adultery does not give individuals a license to enter into intimate relationships outside marriage free from civil or legal implications.
