At a formal ceremony held at Rashtrapati Bhavan earlier today, Justice Bhushan Ramkrishna Gavai was sworn in as the 52nd Chief Justice of India (CJI). President Droupadi Murmu administered the oath, marking a historic occasion—Justice Gavai is the first Buddhist and only the second individual from the Dalit community to ascend to the nation's highest judicial position.
Justice Gavai is set to serve as CJI until his retirement, scheduled for November 23, 2025. He takes over the role from Justice Sanjiv Khanna, who retired on May 13.
Born on November 24, 1960, in Amravati, Maharashtra, Justice Gavai hails from a family deeply rooted in Ambedkarite philosophy. His father, R.S. Gavai, was a well-known leader of the Republican Party of India and held gubernatorial positions in Bihar, Sikkim, and Kerala.
Throughout a legal career spanning more than twenty years, Justice Gavai served at several High Court benches, including those in Nagpur, Aurangabad, Panaji, and Mumbai. His rulings often showcased a combination of compassion and judicial acumen. He once resolved a case involving a woman who had waited two decades to reclaim her home. In another, he issued a verdict that reunited a mother with her infant after a legal battle with her spouse.
Justice Gavai’s empathy was equaled by his strong adherence to constitutional principles. As a judge of the Supreme Court, he made key contributions in cases under the UAPA and PMLA, often emphasizing the importance of due process. He was part of benches that granted relief in high-profile cases, such as those involving Newsclick’s founder Prabir Purkayastha and former Delhi Deputy CM Manish Sisodia. He also took a clear stand against illegal demolitions, reinforcing that state actions must adhere to legal procedures.
A defining moment in his tenure came in 2023, when he wrote a concurring opinion supporting the sub-categorization within the Scheduled Caste quota. Drawing upon his lived experience and constitutional insights, he argued against the notion that all SC reservation beneficiaries are a uniform group—bolstering the ongoing demand for a more refined approach to social justice.
