The main difference between an employee and an independent contractor is the degree of control. There are many different contexts in the law of labor and employment as to what is an employee and what is an independent contractor, but the typical test is do you control the person? Do you control when they start each day, when they finish each day? Do you supply the materials and the place where they work? Do they have other customers or are you the sole customer?
These are the various factors courts will look at, among others, to determine if you are primarily controlling this person, and therefore, they are beholden to you as an employee, or if they're really acting like an independent business, which is what an independent contractor is. They have investments and materials and customers and you're just one of many customers.
