Recently the supreme court of India had stated that the executive magistrate has no power to order FIR on private complaint under criminal procedure code. The judgment is made by Justices Rohinton Nariman and Navin Sinha. In the case, a private complaint has been made by a student who has been cheated in admission to a three year law course in an unrecognized institute.
