Can PM Modi and Amit Shah’s 130th Constitutional Amendment Bill remove criminal leaders from Indian politics?
In this video, we explain the 130th Constitution Amendment Bill 2025 in simple language. The Bill was introduced in Lok Sabha by Union Home Minister Amit Shah on August 20, 2025, and the Modi government may push it again during the July 2026 Monsoon Session.
Under this Bill, if the Prime Minister, a Chief Minister or any minister is arrested in a serious criminal case and remains in custody for 30 consecutive days, they may have to leave office. A serious offence means a crime punishable with 5 years or more in jail.
If the PM or CM does not resign by the 31st day, the post can be lost automatically. A Union minister can be removed by the President on the advice of the Prime Minister, while a State minister can be removed by the Governor on the advice of the Chief Minister.
Right now, MPs and MLAs are mostly disqualified after conviction. But this Bill can trigger action before conviction, based on arrest and 30 days of custody.
The government says this Bill is meant to clean politics and stop serious criminal accused from running governments from jail. But the Opposition argues that central agencies could be misused to target opposition Chief Ministers and ministers.
The Joint Parliamentary Committee is expected to submit its report by July 17, 2026, and the Bill will need a special majority in Parliament to pass.
