WHAT IS THE CRIME OF I.T.S. IN NEVADA DRUG CASES?

Nevada has a useful drug statute under NRS 454.351 that is referred to ITS, which stands for "possession of drugs not to be introduced into interstate commerce." Whereas most Nevada drug charges are felonies, ITS is only a misdemeanor. Often the judge orders no jail time, and the criminal record cam possibly be sealed only two years after the case is closed.

Most commonly, negotiations ("plea bargains") to an ITS involve cases where someone goes to a pool party and brings in a small amount of drugs, or the person is pulled over and drugs are found on his/her person. Defendants who are allowed to plead to ITS usually have little criminal history. The D.A. rarely offers repeat drug offenders plea bargains where they may plead down to ITS.
