Should Mediation begin in Caucus or in Joint Session?
When to Caucus in mediation is an important question and issue for all mediators to deal with and I tend to look at the issue from these starting points:
1. What is the Standard of Practice in your jurisdiction? If you are working for an ADR department follow their standard of practice.
2. Ask the parties what their preference is before mediation begins and proceed accordingly, unless their is a good reason not to such as the presence of Domestic Violence issues for instance.
3. When requested by either party during mediation or as the mediator feels appropriate.
4. Also consider Pre-Framing the issue of Caucus in your Opening Statement to the parties.
