The contractor (Respondent) substituted specified imported tiles with cheaper, locally sourced
alternatives without obtaining approval from the Architect. After handover, the tiles started
chipping and discolouring. The Superintending Officer (S.O.) (Claimant) claimed a breach of
contract due to the contractor’s failure to comply with the specifications, while the contractor
argued that the substitution was necessary due to supply chain shortages.
