Recently, the Supreme Court of India ruled that Section 17A of the Prevention of Corruption Act does not protect public servants accused of demanding bribes when the alleged conduct is unrelated to their official duties. The judgment, delivered on 16 October 2026, clarified when prior government approval is required to investigate corruption allegations.
In Tejaram v. State of Rajasthan (2026), a Supreme Court bench comprising Justices S.V.N. Bhatti and N.V. Anjaria dismissed an appeal by a Rajasthan police constable accused of demanding a bribe of ₹1.5 lakh.
In this video, we explain Section 17A of the Prevention of Corruption Act, 1988, its application to official decisions and recommendations, and why demanding illegal gratification unrelated to official duties does not qualify for protection under this provision.
