FALSE IMPRISONMENT

Under NRS 200.460, it is a Nevada crime to commit false imprisonment, which is unlawfully restricting someone else’s freedom of movement. An example is purposely locking someone inside of a room in order to keep that person from being able to get out. Here are five things to know about false imprisonment.

1) Merely ordering someone to stay still is not by itself a crime. Force or threats would need to be used for it to rise to the level of false imprisonment.
2) False imprisonment is usually a gross misdemeanor, carrying up to 364 days in jail and/or up to $2,000 in fines.
3) False imprisonment becomes a class B felony if the defendant was an inmate, or used a deadly weapon, or used the victim as a human shield or to avoid arrest. Penalties range from one to 20 years in prison depending on the case.
4) Potential defenses to false imprisonment charges are that the defendant acted in self-defense, that the victim consented, or that the incident was an accident.
5) The “shopkeeper’s privilege” allows merchants to detain suspected thieves for a reasonable period of time in order to investigate the matter.
