इस वीडियो में बताया गया है कि जब Tenant के पक्ष में Interim Injunction (Order 39 CPC) लागू हो, तब भी यदि Landlord के कहने पर Municipal Corporation द्वारा दुकान गिरा दी जाए, तो कानून में Tenant के पास क्या remedy बचती है।
यह केस 2015 में दायर Declaration & Permanent Injunction Suit से जुड़ा है, जहाँ सूट लंबित रहते हुए 10.09.2022 को दुकान ध्वस्त कर दी गई। इसके बाद
Order 6 Rule 17 CPC के तहत Subsequent Event जोड़ने हेतु Amendment Application
Section 39 Specific Relief Act के अंतर्गत Mandatory Injunction द्वारा Restoration of Possession
Amendment Rejection के बावजूद Fresh Right to Seek Relief
जैसे महत्वपूर्ण कानूनी प्रश्न उठते हैं।
