In this video, Mike Dryden, Head of the Workers' Compensation Department at Willig, Williams & Davidson, explains a growing and aggressive trend among large Pennsylvania employers, including the City of Philadelphia: using Temporary Notices of Compensation Payable (TNCPs) to delay and ultimately deny legitimate workers' compensation claims.
Under Pennsylvania law, employers have 21 days to accept or deny a work injury claim. A TNCP extends that window to 90 days without admitting liability. During that time, your employer can pay your medical bills and wages, then file a Notice Stopping Temporary Compensation and deny your injury ever happened. If no denial is filed within 90 days, however, the TNCP converts to a full acceptance by operation of law.
