Yes. Thanks to the 2018 Farm Bill (formally known as the Agriculture Improvement Act of 2018), hemp was officially removed from the federal list of controlled substances, making it legal. That change made CBD legal at the federal level, as long as it’s sourced from hemp plants that contain no more than 0.3% THC by dry weight. Under this law, hemp with 0.3% THC or less is classified as industrial hemp. Any cannabis plant with THC levels above that limit is still considered marijuana and remains federally restricted.
With that being said, each state does have the ability to govern as it see fit. If a state finds that the law is being manipulated it can take enforcement action as it sees fit.
