Senior Judge David Sweat orders a redo of the redo of the Georgia House District 28 Republican primary. He called for a new election after the attorney for former Rep. Dan Gasaway presented evidence in court that four of the votes that were cast in Habersham County were illegal. Three of the voters in question had moved out of the county or district. The fourth, it appears, voted twice.
Judge Sweat threw out the four votes. Because they exceeded the two vote margin of victory, he vacated the December election results and ordered a new election.
The decision removes Erwin from office. He has the right to appeal. If he does not, a new election will be held within the next several months. In the meantime, the more than 50,000 residents who live in District 28 will go unrepresented in the Georgia General Assembly.
